-
Legal Reasons. We use personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for legitimate purposes, subject to this Privacy Policy. Such circumstances may include:
-
Service providers. We may disclose personal information to Shopify, vendors and other third parties who perform services on our behalf, such as IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping. These arrangements relate to the relevant Services and do not include the processing of Garmin data. No third party receives or processes Garmin data on our behalf.
-
Business and marketing partners. We may disclose personal information to business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalised advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. These activities do not include Garmin data. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity. You can exercise your rights to opt out of those uses here.
-
At your direction or with your consent. We may disclose information when you direct or request us to do so, or otherwise consent to disclosure, such as to ship you products or through your use of social media widgets or login integrations.
-
Corporate group. We may disclose personal information to our affiliates or otherwise within our corporate group.
-
Legal and business purposes. We may disclose personal information in connection with a business transaction, such as a merger or bankruptcy, to comply with applicable legal obligations, including responding to subpoenas, search warrants and similar requests, to enforce applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.
We do not sell Garmin data or disclose it to third parties for their own purposes.
FLYCARB App and Third-Party Integrations
The FLYCARB App provides features relating to training, activity and performance. If you choose to connect the FLYCARB App to a third-party service, such as Garmin Connect or Strava, you authorise us to access and process information made available by that service in accordance with the permissions you grant.
This information may include activity, training and performance data, together with other information associated with those activities that you have chosen to make available through the connected service. The way we use this information depends on the service you connect, as described below.
Garmin Connect Integration
If you choose to connect your Garmin account to the FLYCARB App, we access Garmin Connect data made available through the Garmin Connect Developer Program APIs, subject to the permissions you grant.
We use Garmin data solely to display your own activity information back to you alongside FLYCARB fuelling recommendations. We do not sell Garmin data, share it with third parties, or use it for advertising or marketing purposes. No third party receives or processes Garmin data on our behalf.
We do not use Garmin data, or information derived from it, to train, evaluate or improve artificial intelligence models, and we do not process Garmin data using artificial intelligence systems.

Data we have already received may continue to be held until it is deleted in accordance with this Privacy Policy.
Your Garmin data rights. You can request access to, correction of, deletion of or a copy of Garmin data held by FLYCARB by contacting us at team@flycarb.com. You can also disconnect your Garmin account through the FLYCARB App to stop further access. We will handle requests in accordance with applicable data protection law and this Privacy Policy.
If you delete your FLYCARB App account, we will delete your personal information, including Garmin data and information derived from it, subject to information we are required or permitted to retain by applicable law.
Other Connected Services
If you connect another third-party service, such as Strava, we may access information made available by that service in accordance with the permissions you grant. We use that information to provide, personalise and improve relevant FLYCARB App features, including functionality relating to your training, activity and performance.
You can disconnect other connected services through the relevant service or, where available, through the FLYCARB App. Disconnecting a service will prevent us from accessing new information from that service, although information already received may continue to be retained and processed in accordance with this Privacy Policy and applicable law.
If you delete your FLYCARB App account, we will delete personal information obtained through connected third-party services, subject to information we are required or permitted to retain by applicable law. Where appropriate, we will also revoke our access to connected services.
Relationship with Shopify
Our online store and website Services are powered by Shopify, which collects and processes personal information about your access to and use of those Services in order to provide and improve them. Information you submit to our store or website may be transmitted to and shared with Shopify and other third parties, including those located in countries other than where you reside, in order to provide and improve those Services.
To help protect, grow and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, other merchants and Shopify. In these circumstances, Shopify is responsible for the processing of your personal information for these purposes, including for responding to requests to exercise your rights over its use.
These Shopify arrangements relate to our store and website Services. Shopify does not receive or process Garmin data, and Garmin data is not shared with Shopify.
To learn more about how Shopify uses your personal information and any rights you may have, visit the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights with respect to personal information processed by Shopify through the Shopify Privacy Portal.
Third-Party Websites and Links
The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated with or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness or reliability of information found on them.
Information you provide in public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of the Services or those third-party platforms, without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.
Children's Data
The Services are not intended to be used by children, and we do not knowingly collect personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the details set out below to request that it be deleted.
As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee perfect security. In addition, information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, provide you with Services, comply with legal obligations, resolve disputes or enforce applicable contracts and policies.
When you delete your FLYCARB App account, we will delete your personal information, including activity information obtained through connected third-party services, subject to information we are required or permitted to retain by applicable law.

Before accepting such a request, we may require proof that you have authorised the agent to act on your behalf and may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.
